Barking-mad situation in court - The Standard

The son of Beijing-linked heavyweight Rita Fan Hsu Lai-tai is taking his next- door neighbor in the Tai Po apartment complex Mayfair by the Sea to court because, he says, a barking dog is a shocking nuisance.

Andrew Fan Chun-wah has filed a lawsuit in the District Court against the dog's owner, Hui Nam-keung.

Among the canine-caused stress to which he and his family are subjected, Fan claims, are long periods of barking late at night and in early morning. And a memorable incident came in March when his domestic helper had a bad fright after the dog found its way to his area of the rooftop.

After failing to stop the nuisance with a lawyer's letter Fan is asking for an injunction.

Fan's application says the dog prevents the family enjoying the quiet of their property, which includes being deterred from going to the rooftop.

He reckons the annoyance is so bad that it's lowered the value of his apartment, so as well as trying to get Hui to take control of the dog Fan wants compensation for the nuisance.
