Two sentenced, two wait | Local News Stories

BISBEE — Two men have been sentenced in connection to a February armed robbery and drive-by shooting, while two others are set to go on trial in December. Shaquille Rice, 24, and Rashawn Avery, 22, were each sentenced July 24 to 4.5 years in prison after admitting to misconduct with a weapon. Both had prior felony convictions, making it illegal for them to possess a firearm.

  Rice and Avery were arrested for the Feb. 4 robbery at a Sierra Vista hotel during where guns were displayed and cash and other items were taken from three people. The next day the robbery victims spotted Rice and Avery near the Sunburst Terrace Apartments. One of the victims was the daughter of 41-year-old Jaime Montoya Olivas.

  According to the Sierra Vista Police Department, Olivas, his daughter, and Joseph Allen Buchanan drove to the apartments to confront Rice and Avery about the hotel incident. Buchanan and Olivas allege Avery threatened the daughter with a gun in a parking area, after which Buchanan, 49, fired in self-defense. Numerous shell casings were recovered from two different guns.

   SVPD took Buchanan and Olivas into custody on charges of endangerment for discharging a weapon near the apartments, disorderly conduct with a weapon, and participating in a driveby shooting. They pleaded not guilty on Mar. 6 and are both out of custody after posting surety bonds. Their joint jury trial starts Dec. 4.  

  Rice and Avery also faced charges in connection with the Feb. 5 shooting. In his plea deal, Rice was not required to admit what activity he was engaged in while possessing the weapon and 12 other charges were dismissed as a condition of the plea. He was given credit toward his sentence for 169 days spent in jail pending resolution of the case.  

  Avery was on probation for a 2015 drug conviction when arrested in February.  He admitted to violating probation and pleaded guilty to two counts of misconduct with a weapon. Avery was sentenced to one year in state prison for the old drug case and will then serve 4.5 years on the first weapons charge.

 When Avery is released from prison in August 2021 he will serve four years of probation for the second weapons charge. Thirteen other charges were dismissed as part of his plea deal.
