Immigrant group in Va. sues ICE over ‘collateral arrests’ it calls unconstitutional

Advocates in Virginia filed a lawsuit Wednesday against four federal immigration agents over a practice known as “ collateral arrests ” that have helped boost the number of undocumented immigrants apprehended under President Trump’s administration. The lawsuit, filed in the U.S. District Court in Alexandria, claims that the Immigration and Customs Enforcement agents violated the constitutional rights of two men who are accused of being in the country illegally, but have been otherwise law-abiding, by detaining them without reasonable suspicion. The ICE agents encountered Mynor Abdiel Tun -Cus and Jose Pajarito Saput in the parking lot of the Fairmont Gardens apartments as they were on their way to work and asked about another man who hadn't lived at the complex for about five years, according to the lawsuit filed by the Legal Aid Justice Center in Northern Virginia, which seeks unspecified damages . In 2013, Randy Dillard was living with his four sons and a daughter in an apartment at 198th Street and Bainbridge in the Bronx. The windows were broken; mold and mildew streaked the walls. In the winter, Dillard’s family had to boil water on the stove to bathe; there was no heat or hot water. When the New York City Housing Authority conducted an inspection of the apartment on behalf of Section 8, the federal rent assistance program that financed Dillard ’s rental, the unit failed the test, and Section 8 stopped paying Dillard ’s landlord, demanding that he make repairs. That winter, Dillard was hospitalized for two months with a bout of emphysema; when he came out, he was served with eviction papers for nonpayment of rent. advertisement “I stood in the middle of my hallway looking around my apartment thinking: What am I going to do with my stuff?” Dillard tells Fast Company . “I told myself: I’m going to end up homeless. I’m going to wind up in a shelter.” Dillard got word of a Bron...

Judge orders DreamHost to turn over inauguration protest website data

A judge ruled Thursday that web hosting company DreamHost must turn over data from an Inauguration Day protest website to federal prosecutors looking to find evidence against people charged with rioting during the event. D.C. Superior Court Chief Judge Robert Morin said there would be safeguards in place to address First Amendment concerns raised by the company, which said it was “problematic” to turn over such sensitive information. As a result of the ruling, investigators will be able to review emails related to the website DisruptJ20 .org and identify those who sent and received communications through the domain. But the judge, who ruled from the bench, ordered the government to abide by strict rules to minimize the collection of information about individuals who communicated through the website but committed no crime. “I am going to be supervising their search,” Judge Morin told the lawyers. The Justice Department said it’s no longer looking for casual visitors to the websit...

James Curtis was on the sidewalk about a block up, alongside northbound traffic , eyeballing a work crew off the side of the road up ahead. He pointed to a broken-up patch of sidewalk at his feet that had filled with sandy dirt. That could stop an electric wheelchair, said Curtis. lacks good sidewalks . CINCINNATI -- Police say a pair of 20-year- olds set fires in an under- construction luxury apartment building overnight . Charges dropped in 2016 Aberdeen double homicide

All charges against Terrell Walton, one of two men accused of committing a double homicide in Aberdeen in June 2016, have been dropped, but police and prosecutors say they have not ended their pursuit of justice for the victims and their loved ones. "We're still working it as an open and active investigation," Lt. Will Reiber, a spokesperson for the Aberdeen Police Department , said Wednesday. Twenty-three charges filed against Walton, 31, of Aberdeen, were dropped Aug. 15, according to online court records . He had not been to trial. He was charged with the shooting deaths of Jumal Rodale Dudley , 43, of Havre de Grace , and Taneisha Chenay Smothers , 31, of Aberdeen. Prosecutors were concerned they could not secure a conviction for murder against Walton after his co-defendant — who faced the same charges based on the same evidence — was only convicted of second-degree assault in a trial earlier this year. "By dismissing it prior to trial, we keep it an open case a...
