Security guard cleared in fatal shooting of David Ludewig at Sunset Ridge Apartments
WESTMINSTER, Colo. - An armed security guard who shot and killed a man after a confrontation at an apartment complex in Westminster earlier this month will not face criminal charges.
Seventeenth Judicial District Attorney Dave Young has determined that the guard fired in self defense.
The shooting happened at about 1:25 a.m. on Aug. 2 at the Sunset Ridge Apartments on Sheridan Boulevard.
Johnny Secrest told 7NEWS his cousin, 24-year-old David Ludewig, was confronted by the security guard while peeing next to a dumpster in the complex's parking lot.
Secrest said the guard threatened to detain them and spray them with mace as he followed them back to their apartment.
When they got to their unit, Secrest said Ludewig, walked in and came back out with an airsoft gun.
That's when the guard shot Ludewig.
Police found the man wounded in the parking lot. He was transported to a local area hospital where he was later pronounced dead.
Secrest said they didn't know the security guard was armed.
"I will say this, it was a mistake. If anybody thinks about pulling out an airsoft gun, it's not a real gun and it'll get you killed. That was his mistake, but this security guard was overzealous and continued to harass us all the way until the end," Secrest said.
Westminster Police said the airsoft gun did not have an orange tip to distinguish it as a toy gun.
The District Attorney's office said both Secrest and Ludewig were intoxicated.
Investigators said Ludewig approached the security guard and pointed the handgun at him.
When the security guard told Ludewig to stop and drop the gun, Ludewig continued to advance with the gun pointed at the guard, investigators said.
The security guard fired two shots, hitting Ludewig twice.
